My Attorney dropped me. Do I still have a case?

Yes! Even if your attorney dropped you, or the insurance company calls your case “disputed liability” you still may have a case.

Every day people in Los Angeles County are let go or neglected by their attorneys. This happens very often in slip and fall accidents in supermarkets, convenience stores, grocery stores and other businesses. It is also a common occurrence in auto accident cases were liability is disputed, i.e. cases were the police, the police report, or the other driver claimed that the accident was your fault.

The scenario is like this. Someone is hurt or injured in a slip and fall or car accident. They see an attorney who takes their case. The attorney makes a claim against the store or the insurance company. The store often responds by telling the attorney that the slip and fall was not their fault because they did not have notice of the spill, dangerous condition or other hazard. Or maybe the store says they didn’t even know that the injured person fell because they failed to notify store personnel or make an accident report.

In an auto case the insurance company may respond by telling the attorney that the police came and investigated the accident and determined that it was the fault of the injured party. Or they might say that their insured, the other driver, claims that the fault lies with the injured party. That happens often in cases involving a left turn on a yellow or red light causing a collision. These cases are called disputed liability.

In either case the store or the insurance companies offer no money.

Many attorneys will give up at this point. They decide it is not worth the time and effort to fight these cases and make sure that justice is done.
